Terms of Service

By accessing or using ProAI Optimization services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these terms, please do not use our services.

These Terms apply to all users of our services, including customers who purchase AI solutions, consultation services, or monthly retainer packages.

ProAI Optimization provides artificial intelligence solutions including but not limited to:

• Voice AI Agents for phone call handling
• Workflow Automation systems
• Chatbots and Customer Support AI
• Predictive Analytics solutions
• Custom AI Systems development
• AI Sales and Marketing Optimization tools
• Consultation and strategy services
• Monthly retainer and support services

Services are provided "as is" and we reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

Pricing and Fees

• Basic Package: $499 - $999 (one-time payment)
• Mid-Tier Package: $1,500 - $3,000 (one-time payment)
• Premium Package: $4,500 - $10,000+ (one-time payment)
• Monthly Retainer: Custom pricing based on services
• Strategy Consultation: $150 per session (credited toward package purchase)
• Training Workshops: Starting at $1,500 per session

Payment Processing

Payment is due upon service delivery or as specified in your service agreement. We accept major credit cards and bank transfers. Payment plans may be available for qualifying customers.

Late Payments

For monthly retainer services, payments not received within 10 days of the due date may result in service suspension. A late fee of 1.5% per month may be applied to overdue balances.

30-Day Money-Back Guarantee

We offer a 30-day money-back guarantee for all packages. If you're not satisfied with the delivered AI solution, you may request a full refund within 30 days of project completion.

Consultation Credit

Strategy consultation fees ($150) are fully credited toward any package purchase. If you choose not to proceed with a package, consultation fees are non-refundable.

Monthly Retainer Cancellation

Monthly retainer services may be cancelled with 30 days written notice. Refunds are not provided for partial months.

You are responsible for:

• Providing accurate information and requirements for AI system development
• Ensuring compliance with all applicable laws and regulations in your use of our AI services
• Maintaining the confidentiality of any login credentials or access information
• Using our services only for lawful business purposes
• Providing timely feedback and approvals during the development process
• Testing and validating AI solutions before full deployment

Prohibited Uses

You may not use our services for:

• Illegal activities or purposes
• Harassment, spam, or unsolicited communications
• Violating privacy rights or data protection laws
• Creating misleading or deceptive AI interactions
• Reverse engineering or attempting to copy our AI systems

Data Collection and Use

We collect and process data necessary to provide our AI services. This may include business information, customer interaction data, and performance metrics. Our full privacy practices are detailed in our Privacy Policy.

Data Security

We implement enterprise-grade security measures to protect your data, including encryption, access controls, and regular security audits. However, no system is 100% secure, and you acknowledge the inherent risks of data transmission.

Data Retention

We retain customer data only as long as necessary to provide services and comply with legal obligations. Upon service termination, data will be securely deleted within 90 days unless longer retention is required by law.

Ownership

ProAI Optimization retains ownership of our proprietary AI technologies, methodologies, and general frameworks. You own the specific AI solutions developed for your business and any data you provide.

License Grant

Upon full payment, we grant you a perpetual, non-exclusive license to use the AI solutions developed specifically for your business. This license is non-transferable and limited to your organization's internal use.

Third-Party Components

Our solutions may incorporate third-party AI services, APIs, or components. Use of these components is subject to their respective terms and conditions.

Service Warranty

We warrant that our services will be performed in a professional manner consistent with industry standards. We guarantee that our AI solutions will function as specified in your service agreement for a period of 60 days.

Performance Disclaimer

While we strive for optimal performance, AI systems are inherently probabilistic and may not be 100% accurate. We do not guarantee specific business outcomes, though we provide performance estimates based on our experience.

Third-Party Dependencies

Our services may depend on third-party platforms, APIs, or services. We are not responsible for failures or changes in third-party services that may affect the performance of your AI solutions.

In no event shall ProAI Optimization be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, resulting from your use of our services.

Our total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid to us for the specific service giving rise to the claim during the 12 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
